State Taxes Department Levies Rs 25.34 Lakhs on Trader For GST Violation

The Enforcement (Central) Kashmir division of the State Taxes Department has collected a penalty of Rs. 25,34,808, marking the highest amount obtained in a single penalty case under the Jammu and Kashmir GST Act, 2017. 

This penalty was imposed on a loaded goods vehicle for its failure to provide the necessary accompanying documents during the movement or transit of goods.

On a tip-off, a team led by Assistant Commissioner Enforcement (Central) Kashmir, Shabnam Rashid, and consisting of inspectors, sub-inspectors, and guards from the central Enforcement Wing apprehended a vehicle with registration number JK01AD 3557. The apprehension took place at a checkpoint set up on NH-44 between Hyderpora Bye-Pass and Batamaloo Bye-Pass.

Deputy Commissioner of the State Taxes Department Enforcement (Central) Kashmir, Parveez Ahmad Raina formed a official team to probe the case meticulously.

The in charge of the vehicle (driver person) has reveal that the loaded goods were only cigarettes. However he was not able to furnish any relevat document as required to be comply with the movement or transit of the goods. 

Consequently, FORM GST MOV- 01 & MOV- 02 were provided to the driver/PIC at that moment & vehicle was confined at Excise and Taxation Complex, Solina, Rambagh, Srinagar.

Additional proceedings under section 129 of JK GST Act, 2017 were started & physical verification pertaining to the goods was performed on the same day under the surveillance of DC/AC Enforcement (Central) Kashmir and as per the penalty was figured under previous section.

On May 10, 2023, the owner of the goods presented themselves before the Deputy Commissioner of Enforcement (Central) Kashmir and submitted an application requesting the release of the goods. After collecting a penalty amount of Rs. 25,34,808, the goods were subsequently released.

The efforts of the team were acknowledged and appreciated by the Commissioner of the State Taxes Department in Jammu & Kashmir, Dr. Rashmi Singh, along with the Additional Commissioner of the State Taxes Department (Administration and Enforcement) in Kashmir, Shakeel Maqbool (ICAS). Both officials expressed their satisfaction and commended the team for their work.
